The Earthquake and Tsunami notification service (the Service) that Owner provides to User via the creation of a User Account on the Quake Alerts App (the Product) is subject to the following End User License Agreement ("EULA"). Please read these Terms carefully.
By continuing to access and use this Product, you are deemed to have understood and agreed to the EULA contained herein. If you do not accept these EULA, you may not use the Product nor its Service.
For the purposes of these EULA, the Product includes all the screens related to the Product excluding any links to third party sites.
Owner reserves the right to update the EULA at any time without notice to User. The most current version of the EULA can be reviewed by clicking on the "Terms of Use" link located in the Settings screen of the Product.
This Agreement, which incorporates by reference other provisions applicable to use of the Service, including, but not limited to, supplemental terms and conditions set forth hereof (" Supplemental Terms") governing the use of certain specific material contained in the Product, sets forth the terms and conditions that apply to use of the Service by User. By using the Service (other than to read this Agreement for the first time), User agrees to comply with all of the terms and conditions hereof. The right to use the Product is personal to User and it is not transferable to any other person or entity. User is responsible for all use of User's Account (under any screen name or password) and for ensuring that all use of User's Account complies fully with the provisions of this Agreement. User shall be responsible for protecting the confidentiality of User's password(s), if any.
This software and its notification service are provided "as is", without warranty of any kind, either expressed or implied, as to the accuracy, completeness, reliability, usefulness of any information provided.
Conclusions drawn from the data, or actions undertaken on the basis of its contents, are the sole responsibility of the user.
Notifications are not available for all earthquakes (even when the event parameters are available within the app) and they are delayed. There is no guarantee that a notification will actually be delivered. Also, your device may not be able to receive push notifications all the time.

IN NO EVENT SHALL OWNER AND/OR ITS RESPECTIVE SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF SOFTWARE, DOCUMENTS, PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR INFORMATION AVAILABLE FROM THE PRODUCT.
When in use, the application can send your approximate location to the backend servers (a random error of ±500m is introduced before the location leaves the device). These location data are processed only to provide you with relevant information (for example: earthquakes near you or the approximate locations where a seismic event was felt, etc). The location data are never shared with anyone. In any case, the User is allowed to choose between three levels of location information usage: Never, While Using the App, and Always (i.e. – Background).

Quake Alerts app is designed to minimize battery usage when “Always” permission is enabled, by adhering to the following principles:
Quake Alerts app is a paid subscription-based service, which offers its users an advanced quake and tsunami alert service as well as necessary information concerning seismic activity around the app user's location.
You can try all the benefits of Quake Alerts app free for 7 days. The free trial starts immediately after selecting a pricing plan. During this period, you are free to cancel your subscription any time you wish. After the end of your free trial, you will be charged according to your pricing plan.
Quake Alerts app costs $2.99 per year (taxes/VAT may apply). Your subscription is set to auto-renew yearly, so you can be sure your protection is never interrupted.
Payment will be charged to your iTunes account at confirmation of purchase. Your subscription auto-renews each year and is managed through iTunes.
Subscription renews automatically unless the auto-renewal is turned off at least 24 hours before the end of the current period. The account will be charged for renewal within 24 hours before the end of the current period.
If you have purchased Quake Alerts app through the App Store, you will need to cancel auto-renewal payments directly with Apple . Open the App Store > Tap on your Apple ID > Tap on your name > Subscriptions > Quake Alerts app.
After the auto-renewal of your subscription is canceled, you can still continue using the service until your subscription period expires.
You are always welcome to choose a plan that suits your needs best. To upgrade your Quake Alerts app subscription , go to the App Store > Tap on your Apple ID > Tap on your name > Subscriptions > Quake Alerts app, and pick a pricing plan.
You will be charged for the new plan at the next payment date.
The author reserves the right to discontinue any or all of the functionalities of this mobile app or to modify these Terms of Use at any time and with no prior warning.
